The Regulatory Framework

The Nevis Online Gaming Ordinance was passed by the Nevis Island Assembly on 29 April 2025, creating a dedicated regulatory body — the Nevis Online Gaming Authority (NOGA) — responsible for licensing, compliance oversight, and enforcement.

NOGA issues two licence categories:

B2C Licence — for operators running player-facing platforms including online casinos, sports betting, poker, lottery, virtual sports, and eSports. A single B2C licence covers all gaming verticals under one instrument.

B2B Licence — for software providers, platform suppliers, and payment infrastructure businesses servicing the iGaming industry.

White-label operations require both a B2C and a B2B licence, along with separate NOGA approval.

Why Nevis?

FATF Whitelist Status The Federation of St Kitts and Nevis is a FATF whitelist member through its membership in CFATF. This means Nevis-licensed operators access the same tier of PSP and banking relationships as Curaçao-licensed operators — at significantly lower cost. For operators whose business model depends on reliable fiat card processing, this directly affects which payment processors will work with you and on what terms.

Zero Tax on Gaming Revenue Nevis imposes no GGR tax, no corporate income tax on offshore income, no capital gains tax, and no dividends tax. The annual regulatory cost is a flat EUR 28,000 regardless of revenue.

Operational Flexibility No physical office, no local directors, no local employees, and no minimum share capital required. Remote management from any jurisdiction is fully permitted. The only mandatory local presence is a registered Reporting Officer at approximately EUR 4,200 per year.

Speed to Market 8 to 12 weeks from company formation to licence issuance. A practical midpoint for operators who need more than what a 30-day Anjouan licence provides but cannot wait six months for MGA approval.

Documentation Requirements

Corporate documents: Certificate of Incorporation, Articles of Incorporation, Certificate of Incumbency (within 3 months), Certificate of Good Standing, By-Laws, and a signed organisational chart showing Directors, Shareholders, and UBOs.

Personal due diligence: Required per Director and per Shareholder or UBO holding 10% or more. Includes a certified passport copy, proof of address, bank reference letter confirming a 2+ year relationship, professional reference letter from a licensed lawyer or accountant, and a full CV in English.

Business plan: Executive summary, marketing plan, 3-year financial projections with stated assumptions, P&L and cash flow statements, and a full compliance framework. NOGA requires detailed projections — high-level summaries will not be accepted.

Compliance policies: KYC Policy, Responsible Gaming Policy, Underage Gaming Policy, and AML Policy, all in dated PDF format.

B2C supporting documents: Proof of domain ownership, geo-IP blocking confirmation, compliant Terms and Conditions, RNG testing certificates, and copies of game and content provider agreements.

Key People to Appoint

Compliance Officer: Must be completely independent of the company structure. Cannot be a Director, Shareholder, or UBO. Must have at least 1 to 2 years of relevant industry experience. Outsourcing is permitted with a named individual designated.

Local Reporting Officer: Must reside in Nevis and be registered with the Nevis FSRC. Handles AML and CFT reporting. Typically arranged through a local registered agent at approximately EUR 4,200 per year.

• KYC verification required before any withdrawal, regardless of amount

• Enhanced KYC triggered when aggregate deposits reach USD 10,000

• Robust AML and CTF systems required as a baseline condition of licensing
