Whilst it’s not considered a Tier 1 jurisdiction like Malta or the UK, known for more stringent frameworks, Kahnawake is considered a credible licence with respected reputation in the iGaming sector.

KGC – The Regulator

The Kahnawake Gaming Commission (KGC) is the respected body that enforces stringent regulation to promote responsible gambling in Kahnawake. Established in 1996 by the Mohawk Council of Kahnawake, a sovereign indigenous territory located in Quebec, Canada, the KGC became one of the first jurisdictions in the world to legally license and regulate online gaming.

Licences in Kahnawake

The Kahnawake Gaming Commission (KGC) offers several types of licenses and authorizations to cover different roles in the online gaming ecosystem. Client Provider Authorization (CPA)

This is the main license for operators offering real-money interactive gaming services to players. It’s issued to companies that wish to operate online casinos, poker rooms, sports betting platforms, lottery and bingo sites, and live dealer and hybrid games.

All operators must host gaming servers at Mohawk Internet Technologies (MIT) in Kahnawake, maintain compliance with the Regulations Concerning Interactive Gaming, renew the licence annually and maintain player protection oversight.

Key Person License (KPL)

This license is issued to individuals who hold decision-making roles within companies that have been granted a CPA. The KGC uses this to ensure that only fit and proper persons oversee licensed gaming operations, that includes directors, senior executives, and compliance officers. Applicants must complete a personal disclosure form and background check (criminal and financial). The licence is required to be renewed annually.

Interactive Gaming License (IGL)

This is the master license under which all CPAs are issued. There is currently only one IGL holder, Mohawk Internet Technologies (MIT). MIT acts as the approved data hosting centre within Kahnawake territory and all gaming platforms licensed under KGC must be physically hosted through MIT. Only CPA holders can apply to be clients under MIT’s infrastructure.

Live Dealer Studio Authorization (LDSA)

This license is granted to entities that operate live dealer studios within Kahnawake, broadcasting real-time gaming sessions (e.g., blackjack, roulette). Operators are required to have a physical setup within Kahnawake, implement game fairness, streaming, and security protocols, and regulatory compliance with studio-specific rules.

Software Provider Recognition (SPR)

Although not a full license, the KGC also offers recognition for software/platform providers that support CPA-licensed operators. This ensures that games are RNG-certified and software providers meet minimum compliance and integrity standards.

How long does the licensing process take?

The licensing process in Kahnawake generally takes around 6 months, if the necessary due-diligence and documentation is provided.

The preparation and compliance take up to 3 months, and up to 2 months for the application phase, thereafter the applicant is granted with a 6-month provisional licence. During this period the company will undergo an audit and if the applicant meets all the necessary requirements, they will be issued the full licence.

Licence requirements

To apply for a licence, an operator must fulfil several legal, technical and operational requirements.

Applicants are required to register a company, which does not have to be located within Kahnawake, however all applicants are required to host their server in Kahnawake at Mohawk Internet Technologies (MIT) at their facility.

The company must adhere to the compliance requirements in Kahnawake, be able to demonstrate the availability of capital, suitability of key persons including CVs, annual reports of the company, and a detailed business plan. There are also several independent forms the applicant will be required to complete.

The business plan must contain details on financials, AML policies, KYC procedures, software and RNG certifications. All directors, shareholders and any key individuals of the gaming entity will be required to complete due diligence, which will submitting personal information.
